Section 1.0 Replay® Promotion Description
The Replay® Promotion (Replay®) is offered by the New Hampshire Lottery Commission (NHLC) to promote the sales of all of its games by offering players a second chance to win additional prizes with non-winning NHLC lottery tickets. A lottery player registers to participate in Replay® through the NHLC's authorized website and is then eligible to enter their valid non-winning NHLC lottery tickets to earn points. The player then uses these points to enter drawings offered by the NHLC. Depending on the prize, entries will require various points to enter.
Players can also win instant prizes at the time of ticket entry. Internet players will receive instant notification of the win and the method to receive their prize.
Most of the mid-tier and high-tier drawing and instant win prizes are provided by promotional partners in exchange for promotional consideration.
Section 2.0 Definitions
2.1 The following definitions shall apply for the New Hampshire Replay® Promotion:
"Replay®" or "Replay® promotion" means a marketing program offered by the NHLC that allows lottery players an opportunity to exchange non-winning tickets for points that are used to enter drawings for prizes.
"NHLC" means the New Hampshire Lottery Commission.
"Player" means a person who participates in Replay® by registering and then using an eligible NHLC lottery ticket.
"Replay® account" means an electronic file maintained by the NHLC or its designee which contains information about a player including the number of points available to be used by the player to enter Replay® drawings.
"Eligible" means as authorized by the NHLC.
"Immediate family member" means a person living in the same household.
"On-line game" means a lottery game sold through and printed by a NHLC sales terminal.
"Instant scratch game" or "instant scratch tickets" means a lottery ticket sold by a NHLC retailer that requires the player to remove a covering to reveal the play symbols to determine if the ticket is a prize winner in accordance with game instructions.
"Points" means a non-monetary numerical value assigned by the lottery to a player's Replay® account in exchange for the entry of a valid non-winning lottery ticket.
"Instant win" means a prize that is awarded, as a result of selection by a software algorithm, to a player upon completion of the player entering required information from a valid lottery ticket.
"Mid-tier drawing" means a random selection process, as approved by the NHLC, that will be conducted at a time designated by the NHLC and that will award a designated prize to a selected player.
"Ultimate Replay® drawings" means a random selection process, as approved by the NHLC, that will be conducted at a time designated by the NHLC and that will award a designated prize to a selected player.
"Promotional partner" means a business that provides a prize or prizes to be awarded through the Replay® promotion.
Section 3.0, Player and Ticket Eligibility.
3.1 Player eligibility:
Players shall be 18 years of age or older to have a Replay® account.
Players shall open no more than one account per name and email address or one account per name and mailing address.
Employees of the NHLC and their immediate family members, and employees and the immediate family members of the ad agency of record, are not eligible to enter or win.
A player shall be considered ineligible and their points are voided if the NHLC determines that a player provided false information or does not meet all player eligibility requirements, and the player will be ineligible to receive a prize from the Replay® promotion.
Separate accounts can not be combined.
3.2 Ticket eligibility:
Non-winning NHLC instant scratch tickets are eligible to be entered up to one year from termination of the game(s) pursuant to Sw 1004.
Non-winning online games (Megabucks Plus, Pick Three, Pick Four, Paycheck or other games as authorized by the NHLC) are eligible for Internet entry after 9:00 AM the day after the final draw date on ticket (including multi-draw non-winning tickets). Powerball and Hot Lotto non-winning tickets may be entered after 9 AM two days after the final draw date on the ticket. Eligible tickets may be entered up to one year from the draw date on the ticket.
Non-winning Fast Play tickets are eligible to be entered after 9:00 AM the day after purchase.
All active subscriptions for the Megabucks Plus/Powerball games are eligible for points.
Section 4.0, Prizes
4.1 Odds of Winning:
Odds of winning any prize depends on the total number of eligible entries received and the total number of prizes in the prize pool at any given time.
The instant win prize pool may vary from day-to-day.
The number of prizes offered for mid-tier and Ultimate Replay® drawings other than instant win may vary.
4.2 Prize characteristics:
Prizes can not be redeemed for cash unless otherwise authorized by the NHLC prior to the drawing.
A prize shall be awarded to the player and address that corresponds with the account that won a prize.
Prizes are non-transferable and non-refundable unless otherwise authorized by the NHLC prior to the drawing.
Any applicable local, state or federal taxes are the sole responsibility of the prize winner unless otherwise stated.
Replay® rules are subject to modification and change and will be posted at www.nhlotteryreplay.com.
The awarding of all prizes is subject to eligibility verification.
If a prize won is not readily available to be awarded the NHLC reserves the right, in its sole discretion, to substitute another prize of similar value.
Section 5.0 Player Registration Process
5.1 Registration through the website:
Players may register for a Replay® account through the authorized NHLC website and provide the following information:
First and last name,
Email address,
Password,
A mailing and residential address,
Contact phone number, and
Birth date.
5.2 Required conditions to be a valid registrant:
Players shall read and mark the appropriate boxes to indicate their acceptance and/or their confirmation that the player:
Is at least 18 years of age, and
Accepts the terms and conditions of the Replay® promotion.
5.3 Optional conditions available to a registrant:
Players may, but are not required to, mark the following boxes to indicate their acceptance of other Replay® promotions including but not limited to:
Replay® promotion email updates,
NHLC email updates, and
NHLC winning numbers updates.
Section 6.0 Ticket Entry Process
6.1 Entry mechanisms:
Players with an active Replay® account shall submit their entries through the lottery's designated Internet website.
6.2 Entry by Internet:
Players entering their on-line game ticket information through the NHLC's Internet site shall provide the following information to qualify for associated point values:
The six digit terminal number, and
The fifteen digit serial number.
Players entering their instant game ticket information through the NHLC's Internet site shall provide the following information to qualify for associated point values:
The thirteen digit serial number, and
The three digit ticket number.
Players entering their subscription confirmation card information through the NHLC's Internet site shall provide the following information to qualify for associated point values:
The subscriber number, and
The six digit subscription number
6.3 Limit to the number of entries:
The NHLC reserves the right to limit the number of tickets any one individual may enter during a given time period.
Section 7.0 Replay® Points
7.1 Using Replay® Points Through the Replay® Website for Prize Drawing(s)
Registered Replay® players may use some or all of their Replay® points through the Internet to enter their choice of Replay® drawings, as offered by the NHLC, by:
Entering their registered Replay® email address and password,
Selecting the prize drawing they wish to enter,
Designating the number of Replay® points they wish to exchange for entries,
Clicking on the appropriate entry button to submit the points.
Points used for a drawing shall be deducted from the Replay® player's account balance and can not be used for any future drawing(s).
The number of points exchanged for an entry shall be pre-determined by the NHLC and shall be posted on the Replay® website in proximity to the prize entry box.
Once entered, prize points or their associated entry(ies) can not be cancelled.
It is the Replay® player's responsibility to ensure that the appropriate prize drawing is selected and the correct number of points are entered prior to submitting the points.
Points remaining in a player's account after a drawing deadline may be used for a future drawing unless otherwise indicated in sections 3.1 or 13.0 of these rules, or if the NHLC deems the points or the registered player to be ineligible pursuant to these rules et al.
Replay® points are not transferable.
Replay® points shall be valid only for NHLC approved Replay® drawings and other promotional activities associated with the Replay® promotion, and are not valid toward other NHLC games or their drawings.
7.2 Point Values
There is no cash value for Replay® points.
Cash shall not be awarded in lieu of a merchandise prize unless otherwise authorized by the NHLC.
Point values are exchanged for non-winning tickets based on a value assigned by the NHLC in relation to the price paid for the ticket or as authorized by the NHLC.
Section 8.0 Entry Deadlines for Selected Drawings:
8.1 Entries by Internet:
Length of entry time and prize drawing dates will be clearly posted on the NHLC web site next to each prize offered.
The NHLC reserves the right to change the drawing date, subject to public notice, no later than 24 hours prior to the scheduled drawing or earlier as a result of force majeur.
Drawing dates will be posted on the NHLC Web site or available by calling NHLC headquarters at (603)271-3391.
Entries that are not recorded in the NHLC's computer for a selected drawing shall be void for the selected drawing, and the points shall remain in the player's account.
Section 9.0 Winner Selection Process:
9.1 Instant wins.
All instant wins are selected by a computer software program based on the number of prizes available and the anticipated number of entries that will be entered.
The prize pool and odds of selection may vary from day-to-day as determined by the NHLC.
9.2 Mid-tier and Ultimate Replay® drawings.
All winners of mid-tier and Ultimate Replay® drawings requiring point entries are randomly selected through the use of a computer algorithm from the valid entries received for the selected drawing.
Odds of winning are dependant on the total number of entries for that particular prize.
The number of prizes offered per drawing or length of draw entry period may vary as determined by the by the NHLC.
Section 10.0 Notification and Prize Claim Process:
10.1 Notification of instant wins for Internet entries:
All players of instant wins will be notified immediately upon completion of ticket entry.
A screen will appear with prize description and prize redemption instructions.
A confirmation e-mail will be sent to the e-mail address currently on file for the participant.
Each prize notification will clearly state how to claim the prize.
A winner of a prize will receive their prize through one or more (if applicable) methods:
By mail,
By coupon transmitted through the Internet for redemption,
By going to the marketing prize sponsor location, or
By going to the NHLC headquarters.
The NHLC shall determine how players shall claim prizes on a prize-by-prize basis. Immediately upon notification, the participant may elect not to accept an instant win prize and accept, instead, a number of points as pre-determined by the NHLC, which can be used as entries into other offered prize(s), as selected by the participant.
Points accepted in lieu of a prize will be credited to the player's account balance following the completion of the transaction.
10.2 Notification of mid-tier or Ultimate Replay® drawing wins by Internet:
For drawings that require point entries, the winner will be notified within three weeks of the drawing, by e-mail to the e-mail address currently on file for the participant.
The e-mail will clearly state how to redeem the prize won.
A winner of a prize will receive their prize through one or more (if applicable) methods:
By mail,
By on-line coupon transmitted through the Internet for redemption,
By going to the marketing prize sponsor location, or
By going to the NHLC headquarters.
The NHLC shall determine how players shall claim prizes on a prize-by-prize basis.
10.5 Tax reporting and liabilities:
For Replay® prizes with a value, as designated by the promotional partner, of $600 or greater the winner will receive a 1099 form from the promotional partner that provided the prize.
The prize winner is responsible for all applicable taxes unless otherwise stated by the NHLC.
11.0 Indemnity:
The NHLC and its advertising agency of record offers no warrantees or guarantees of product quality and that availability and quality of the prize and its conformance to advertised representations is the sole responsibility of the promotional partner.
The NHLC and its advertising agency of record shall not be responsible for any prizes lost, damaged or stolen during shipment, pick-up or use.
The NHLC and its advertising agency of record shall not be responsible for injury or loss of life resulting from any prize awarded.
12.0 Replay® promotion changes:
The NHLC reserves the right to change the Replay® promotion in any way and at any time.
13.0 Replay® promotion termination:
The NHLC reserves the right to terminate the Replay® promotion subject to appropriate public notification.
Any unused player points remaining in a player's account after the public noticed deadline date to use the points shall be considered expired and void, and ineligible for any further use.
14.0 Player Agreement:
By registering as a Replay® player, the player hereby agrees to accept these conditions and to abide by all applicable NHLC rules and regulations in order to participate in the NHLC Replay® promotion and be eligible to win a prize.
15.0 Privacy Policy:
Your e-mail address will not be sold or shared with any outside parties. The NHLC does not sell, rent, share, or otherwise disclose mailing lists or other personally identifiable information. Participants may choose to opt-in for NHLC Replay® e-mail communications, consisting of program news, NHLC game information, and marketing messages about marketing prize partner companies. E-mail messages will only be sent from the NHLC or its agent, and profiles will not be released to marketing prize partners without expressed electronic consent from the player.
New Hampshire Right to Know state law requires that a winner's name, town, and prize won be available for public information. Street address and phone number is not considered public information unless ordered by a court of appropriate jurisdiction. By agreeing to these terms, the NHLC and promotional partners reserves the right to use your name, town, and image in any promotional materials, including Web site, e-mail, print, TV and/or radio.
16.0 Security Policy:
The New Hampshire Lottery Commission (NHLC) and its web site vendor have taken numerous steps to protect the safety and security of the NH Lottery Replay web site. These measures are designed and intended to prevent corruption of data, block unknown or unauthorized access to our systems and information, ensure the security of any information that is transmitted, and maintain the integrity of the Replay promotion.
The NH Lottery Replay web site is a promotional platform and it is separate and distinct from all other NHLC gaming operations and associated data. The NH Lottery Replay web site is hosted in a secure server environment entirely separate from NHLC gaming operations and networks. Data related to the web site is also maintained in a secure environment separate from NHLC gaming operations and networks.
WARNING -- The NH Lottery Replay system is monitored regularly by NHLC personnel and its web site vendor. If security monitoring reveals possible criminal activity or any attempts to circumvent the security and rules of the game, information pertaining to such activity may be provided to the New Hampshire Attorney General’s Office, possibly resulting in prosecution. Additionally, the NHLC will also immediately and without warning revoke a player’s Replay membership permanently and all points or prizes that have been awarded.
